- Tinyhosts.com provides website services hosting to a large number of clients. We have a responsibility to protect each client and provide the best services available. The following guidelines have been established to ensure this intent is met.
- Domain name Registration Domain names of the following TLD:
.com .net .org .co.uk .org.uk are registered by us free of charge and become the property of the customer after a period of twelve months providing the domain remains hosted by us for a minimum period of one year. Should the customer wish to transfer hosting before the end of any current or subsequent twelve month hosting period a charge will be made for the domain name at $14 plus a $20 handling fee. Domains not hosted on our servers are charged yearly renewal fee’s of $14 /year + $20 handling.
- Domain name transfer Domain names transfered into our care with the following TLD’s: .com .net .org .co.uk .org.uk will be renewed for the minimum period allowed, TLD’s other than the above can be hosted with us but do not qualify for our free domain name renewal service. In order to take advantage of our free renewal service the domain must be transfered into our care. If you wish us to transfer your domain to our registrars we will need an email request from the domain names registrant, once we have received this email we will initiate the transfer sequence from our registrars. All domains hosted by us MUST resolve to our servers, for security reasons we will not permit an unresolved domain to remain on the server.
- Content: All services provided by Tinyhosts.com may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secrets and other statutes.
Tinyhosts.com is not responsible for any claims resulting from the use of our service. This is also true for sites that promote any illegal activity or content that may be damaging to Tinyhosts.com servers or any other server on the internet. Links to such materials are prohibited. This includes, but is not limited to illegal adult sites, warez/irated software, serialz, hacker programs/archives, and illegal MP3 files.
- Background Running Programs: We allow programs to run continually in the background. However, these are considered on a one to one basis and an extra charge may be incurred based on system resources used and operational maintenance needed. Port forwarders are NOT allowed under any circumstances.
- IRC: We currently DO NOT allow IRC, IRC bouncers, IRC bots, egg drops, or similar software to be operated on our servers.
- Accessing Other Systems: We do not allow illegal or unauthorized access to other computers or networks belonging to another party, or attempts to penetrate security measures of another individual's system (often known as "hacking"). We also do not allow any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity). Shell activity and su attempts are recorded.
- Unsolicited Commercial Email (UCE): SPAM Spamming, or the sending of unsolicited email, from an tinyhosts.com server or using an email address that is maintained by tinyhosts.com is STRICTLY prohibited and will qualify your site for immediate deactivation with no warning and no refund. Tinyhosts.com will be the sole arbiter as to what constitutes a violation of this provision. Additionally claims investigated by tinyhosts.com about spam from any of our users or users of theirs, will be fined and billed for such work.
- Bulk Email
The use of our network to send bulk email whether opt-in or otherwise, and the use of bulk email to promote a site on our network is strictly forbidden.
- Server Abuse: Any attempts to undermine or cause harm to any Tinyhosts.com server or customer of Tinyhosts.com is strictly prohibited. Tinyhosts.com holds no responsibility for the use of our clients' accounts. Any account the abuses resources and actions are not taken to desist, calls for immediate de-activation without any refund of payments made thus far. Any site using what we deem to be excessive CPU cycles or any resources that cause strain to other sites may also be offered new terms.
- Data Transfer: Each account is allocated a pre-specified amount of data transfer (also known as bandwidth) per calendar month. Sites are not restricted to a traffic rate but if your account's monthly usage is above your monthly total allotment, by default, the server will suspend your account until the following calendar month, when your new quota begins. Optionally you may choose to either upgrade to a higher package or decide to purchase additional data transfer when required. We will work with clients to keep their sites alive and fast at all times.
- Backups: Tinyhosts.com performs periodic backups of critical system files for emergency purposes only. Clients should not rely on Tinyhosts.com to perform site/data backups for them customers are responsible for backing up their own data. An easy-to-use instant backup facility is available via the client's online control panel. MySQL data dumps can be easily performed by the client via the included phpMyAdmin or Telnet/SSH. Clients are advised to backup all of their own files to their local drives. Tinyhosts.com is NOT responsible for lost data, time, income or any other resource due to hardware failure, faulty backups or non-existant backups.
- Billing: The first payment is due on the signup date. Subsequent payments are due every 30 days following this date (for monthly billing cycles), or every 360 days following this date (for annual billing cycles). Accounts 5 days past due will be de-activated. Accounts 10 days past due will be deleted from the server without a refund of any payments made thus far. ALL accounts MUST have a valid subscription and a current paid hosting period, if your subscription is canceled and we are unable to contact you to re-establish the subscription your website will be deemed to have been abandoned and deleted. If any terms or conditions are failed to be followed the account in question will be automatically deactivated. You will be billed by either 2checkout.com or PayPal.com, this is also the name that will appear on your credit card statement, please make a note of this to avoid confusion at a later date. You are also giving us permission to register your domain name for you when selecting "new domain" in the order form of our site. Any chargebacks will be dealt with very seriously, we reserve the right to forward any owed debts (e.g. resulting from a chargeback) to our debt collection agency, whom will add their fee and interest to the total, this may also affect your credit rating.
- Cancellation: Cancellation can be made via the Terminate page
Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 30 days of service and no terms are breached all hosting fees will be refunded. This does not include fees for domain registration. We reserve the right to remove any account without prior notice for any reason. If your account is cancelled for violation of these terms and condition you will not be entitled to a refund.
- Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion.
IN NO EVENT WILL TINYHOSTS.COM BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE TINYHOSTS SERVICES OR ANY CONTENT THEREON.
THIS DISCLAIMER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY ANY FAILURE OF PERFORMANCE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; DELAY IN OPERATION OR TRANSMISSION; COMPUTER VIRUS; FILE CORRUPTION; COMMUNICATION-LINE FAILURE; NETWORK OR SYSTEM OUTAGE; OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.
These terms may be modified at any time and without notice. All users previous and new are always subject to the newest terms posted here at all times.
